These Terms govern the rights, obligations and responsibilities between Kim Hyo-jun (the "Company") and the subject of personal location information (the "User") in relation to the NatureLens location-based service.
Article 1 (Purpose)
These Terms set out the conditions and procedures for using the location-based service the Company provides, and the rights and obligations of the Company and the User. Matters not covered here follow the Terms of Service, the Privacy Policy, the Act on the Protection and Use of Location Information ("Location Information Act") and related laws.
Article 2 (Definitions)
- "Location information" means information about a place where a movable object or an individual is or was at a particular time, collected or estimated through a device's location function, photograph capture data, network information and the like.
- "Personal location information" means location information about a specific individual, including information that can readily identify an individual when combined with other information.
- "Subject of personal location information" means the person identified by personal location information.
- "Location-based service" means a service provided using location information — showing where a nature record was found, recording a survey route, displaying maps, and providing area-based information.
Article 3 (What the Service Does)
The Company provides the following location-based services.
- Tagging nature records with location — recording the coordinates and address where an observation photograph was taken
- Recording survey routes — continuously recording the coordinates and distance of a walk
- Map display — showing recorded points and routes on a map
- Area-based information — observation statistics and environmental information by area
All of the above are currently provided free of charge.
Article 4 (How and What Location Information Is Collected)
- The Company collects location information only where the User has consented. Consent is obtained through the operating system's permission prompt when the app first runs, together with in-app guidance.
- Once a User starts a survey, location continues to be collected while the screen is off or another app is in use. This is so that a survey route is not broken while walking in the mountains; collection stops when the survey ends.
- Battery use may increase while background collection is running.
- The User may stop collection at any time by revoking the location permission in the device's operating system settings. Features that require location will then be unavailable.
Article 5 (Purpose and Retention of Location Information)
- Location information collected is used to provide the services in Article 3, to compile statistics on the distribution of species by area, and to improve the quality of the Service.
- Location information contained in a nature record is retained for as long as that record is retained, and is deleted when the record is deleted.
- Location information is destroyed without delay once its purpose is achieved. Statistical material processed so that individuals cannot be identified may continue to be retained.
Article 6 (Rights of the Subject of Personal Location Information)
- The User may withdraw consent to the collection, use or provision of personal location information, in whole or in part, at any time.
- The User may request that collection, use or provision of personal location information be suspended temporarily. The Company will not refuse such a request and maintains the technical means to give effect to it.
- The User may request access to, or notification of, the following material, and may request correction where it contains errors. The Company will not refuse without just cause.
- Records confirming the collection, use and provision of the User's own location information
- The reason for, and content of, any provision of the User's personal location information to a third party under law
- Where consent is withdrawn, the Company destroys the personal location information collected and the confirmation records without delay. Confirmation records that must be preserved by law under Article 9 are destroyed once that period ends.
- To exercise these rights, contact catstopia@gmail.com or 010-6751-0320.
Article 7 (Rights of a Legal Representative)
Where the Company intends to collect, use or provide the personal location information of a child under 14, it obtains the consent of that child's legal representative. The legal representative may exercise all of the User's rights under Article 6.
Article 8 (Rights of a Guardian of a Child Aged 8 or Under)
- Where the guardian of a person falling under any of the following (a "child aged 8 or under") consents to the use or provision of personal location information for the protection of life or body, that consent is deemed to be the consent of the person concerned.
- A child aged 8 or under
- A person under adult guardianship
- A person with a mental disability under the Act on Welfare of Persons with Disabilities who is a person with a severe disability under the Act on the Employment Promotion and Vocational Rehabilitation of Persons with Disabilities (limited to those registered as having a disability)
- A guardian who wishes to consent must submit a written consent form to the Company, attaching a document proving guardianship.
- A guardian may exercise all of the User's rights.
Article 9 (Retention of Records Confirming Collection, Use and Provision)
Under Article 16(2) of the Location Information Act, the Company automatically records and preserves in its location information system, and retains for six months, records confirming the collection, use and provision of location information. This material must be retained by law and is therefore not subject to a User's deletion request.
Article 10 (Entrustment of Location Information Processing)
The Company transmits coordinates to map providers in order to display maps and convert addresses. The entrusted parties and the countries to which data is transferred are disclosed in Article 7 of the Privacy Policy.
Article 11 (Provision to Third Parties and Sharing of Routes)
- The Company does not provide personal location information to third parties except with the User's consent or where there is a legal basis.
- Where personal location information is provided to a third party designated by the User, the Company informs the User in advance of the recipient and the purpose, and obtains consent.
- Where information is provided under paragraph 2, the Company notifies the User on each occasion, immediately and through the communications terminal from which the personal location information was collected, of the recipient, the date and time, and the purpose.
- Where a User chooses to share a survey route, that route is visible to other Users. In that case certain stretches near the start and finish are omitted so that the User's home area is not revealed. Sharing can be turned off at any time.
Article 12 (Change and Suspension of the Service)
The Company may change or suspend all or part of the location-based service where this is unavoidable — maintenance of equipment, loss of communications, a change in a map provider's policy, or an amendment to the law. The Company gives notice in advance, or afterwards where the matter is urgent.
Article 13 (Compensation and Dispute Resolution)
- Where the Company causes loss to a User by breaching Articles 15 to 26 of the Location Information Act, the User may claim compensation. The Company cannot escape liability unless it proves the absence of intent or negligence.
- Where a dispute concerning location information arises between the Company and a User, the parties will confer in good faith. If no agreement is reached, the User may apply to the Korea Communications Commission for adjudication under Article 28 of the Location Information Act, or to the Personal Information Dispute Mediation Committee under Article 43 of the Personal Information Protection Act.
